RENTAL AGREEMENT TERMS & CONDITIONS

  1. The medical equipment is the property of JJ Healthcare Products and is in good condition, clean, and sanitized. The Renter shall return the equipment in the SAME condition as when picked up at/ delivered by JJ Healthcare Products, at the end of the rental period.
  2. The rental term commences on the pickup/delivery date and ends upon the date when the equipment is required to be returned to JJ Healthcare Products.
  3. All rentals under this Agreement shall be paid up front and in advance before the commencement of the equipment rental whether it be rented for a day, a weekend, a week, several weeks, a month, or multiple months.
  4. Please be advised that for all orders, a valid debit/credit card information or cash will be requested by one of our agents in order to complete the order and Rental Agreement.
  5. Upon pickup or delivery of the rental equipment, JJ Healthcare Products may request a photo ID.
  6. If the equipment is not returned upon the end of the rental term, JJ Healthcare Products will charge the Renter the difference between the amounts paid as rent and the rent amount of the additional days.
  7. Please keep in mind the date of pickup if requested. The Renter will receive a call by JJ Healthcare Products either the day before or the morning of as a courtesy reminder to confirm pickup time. We do our very best to accommodate our customers, we will be glad to provide you with a window of 2-3 hours within which delivery will occur.
  8. JJ Healthcare Products’ delivery area includes all of GTA. For deliveries outside this area, the decision will be upto JJ Healthcare Products if arrangements can be made possible and additional delivery charges may apply.
  9. Extension of rental term should be notified day before or morning of original rental term period end date. A new order will be created including the re-request of payment information for the completion of the order.
  10. Cancellation of a rental order is not permitted. Once the order has been placed and confirmed, no cancellation will be allowed. If so ever for (exceptional case), there will be a cancellation fee of 50% of the total amount.
  11. JJ Healthcare Products shall have the right to immediately retake and repossess the equipment with or without process of law and terminate this Agreement, if: (a) the Renter avoids making any of the required rent or other payments when due; (b) the Renter fails to comply with any of the terms and conditions herein.
  12. The Renter hereby accepts and shall bear the risk of loss and damage to the equipment from any and every cause whatsoever and shall keep and maintain the equipment in good condition and working order. In the event of loss or damage to an equipment, the Renter at the decision of JJ Healthcare Products agrees to repair or replace damaged or lost equipment, the cost of such repairs and replacement will be decided by JJ Healthcare Products.
  13. Without the prior written consent of JJ Healthcare Products, the Renter shall not make any alterations, additions or improvements to the equipment. All additions and improvements shall be assessed by JJ Healthcare Products to consider.
  14. If the Renter is interested in purchasing the equipment that he/she is renting, our Rent-to-Own option is available. If the Renter has rented the equipment for a maximum of a 1 month rental period, the same equipment or new equal product will be available for purchase and the total rental amount will be deducted from the total purchase amount. If the Renter has rented the equipment for more than a month, a maximum of $100 will be deducted from the total purchase amount.
  15. The Renter assumes all risk and liability for any loss, damage or injury, including death, to persons or property of the Renter or others arising out of the use, operation or driving of the equipment.
  16. The Renter shall operate the equipment with care and diligence. Under no circumstances shall the equipment be operated by any person: a) while under the influence of intoxicants or b) in an unsafe manner.
  17. The Renter shall defend, indemnify and hold harmless JJ Healthcare Products, all of their agents, officers, shareholders, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation or driving of the equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of JJ Healthcare Products or its employees.
  18. The Renter shall notify JJ Healthcare Products immediately of all accidents and damage resulting from the use, operation or driving of the equipment.
  19. No equipment shall be sublet by the Renter, nor shall he/she assign or transfer any interest in this Agreement without written consent of JJ Healthcare Products.
  20. This Agreement constitutes the entire agreement between the parties; and it shall not be amended, altered or changed except by a written agreement signed by the parties.
